Draft Notice of Privacy Practices
Please review carefully. This section describes
how medical information about a patient may be used and disclosed,
and how a patient may obtain access to that information. It remains
a draft until formally adopted.
A pharmacy subject to the Health Insurance Portability and Accountability Act must protect the privacy of protected health information, provide a notice of its legal duties and privacy practices, notify affected individuals following certain breaches, and follow the notice currently in effect. California privacy law may provide additional protections.
How health information may be used
Payment
Health information may be used or disclosed to submit and administer claims, confirm eligibility or coverage, coordinate benefits, collect amounts due, or respond to a payer audit.
Health-care operations
Health information may be used for quality review, staff training, licensing, compliance, credentialing, patient-safety work, recordkeeping, and other lawful pharmacy operations.
Information may also be used or disclosed when permitted or required by law, including for certain public-health, health oversight, judicial, administrative, law-enforcement, workers' compensation, organ-donation, research, and safety purposes. The pharmacy will apply any authorization, minimum-necessary, attestation, or other condition required for a particular use or disclosure.
Uses requiring permission and additional safeguards
Written authorization
Uses and disclosures not otherwise permitted or required by law generally require written authorization. A patient may revoke an authorization in writing, except to the extent action has already been taken in reliance on it.
Sensitive information
Special rules may apply to psychotherapy notes, substance-use disorder records, reproductive-health information, genetic information, and other records protected by federal or California law.
Marketing, sale, and fundraising
The final notice will identify the pharmacy's practices and any authorization requirements for marketing, sale of protected health information, and fundraising. This language is pending legal and operational review.
Patient privacy rights
Records and corrections
A patient may have rights to inspect or obtain copies of certain records and to request correction of information believed to be incorrect or incomplete, subject to lawful limits.
Disclosures and restrictions
A patient may request an accounting of certain disclosures and may request restrictions on uses or disclosures. Some requests need not be accepted; certain fully self-paid services may be subject to a required health-plan restriction.
Confidential communications
A patient may request reasonable communication by a particular method or at a particular location and may request a paper copy of the final notice.
Complaints without retaliation
A patient may complain to the pharmacy or to the U.S. Department of Health and Human Services Office for Civil Rights. The pharmacy may not retaliate for filing a privacy complaint.
